Terms and Agreements

Welcome to Okanagan History (“we,” “us,” or “our”), operating the website okanaganhistory.com (the “Site”). These Terms and Agreements (“Terms”) govern your access to and use of the Site and your purchase of any products from us.
By browsing the Site, placing an order, or completing a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or place an order.
1. About us

2. Eligibility
You must be at least the age of majority in your province, territory, or state of residence to place an order. By placing an order, you confirm that you meet this requirement and that all information you provide is accurate and complete.
3. Our products
We sell original vintage and historical photographs, prints, negatives, ephemera, and related collectible items. Because these are aged, one-of-a-kind or limited-availability objects, please note the following:
Condition. Items are sold as-is in the condition described and shown in the product listing. Age-related characteristics — including but not limited to surface wear, creasing, foxing, fading, silvering, edge chipping, adhesive residue, handwritten annotations, stamps, or trimming — are normal for material of this age and are not defects unless we state otherwise.
Photographs of items. Product images show the actual item you will receive unless clearly stated otherwise. Colour, tone, and contrast may vary slightly between your screen and the physical item. Watermarks appearing on Site images do not appear on the physical item you receive.
Descriptions and dating. We describe items to the best of our knowledge based on available information, markings, and research. Dates, locations, subjects, and attributions are offered in good faith as our best assessment and are not guaranteed. Where information is uncertain, we indicate this in the listing.
Availability. Most items are unique. Listing an item does not guarantee availability, and stock is confirmed only when your order is accepted.
4. Pricing, currency, and taxes
All prices are listed in Canadian Dollars (CAD) unless expressly stated otherwise.
Applicable federal and provincial taxes are calculated and displayed at checkout based on your delivery destination.
We reserve the right to correct pricing errors. If an item is listed at an incorrect price due to a typographical or system error, we may cancel the order and issue a full refund, whether or not the order has already been confirmed.
Prices are subject to change without notice, but changes will not affect orders already accepted.
5. Orders and acceptance
Your order is an offer to purchase. A confirmation email acknowledges that we received your order; it does not constitute acceptance.
A contract is formed only when we dispatch the item or otherwise confirm acceptance in writing.
We reserve the right to refuse or cancel any order at our discretion, including where:
- the item is no longer available or was sold through another channel;
- there is an error in pricing, description, or availability;
- we are unable to verify billing or shipping information;
- the order appears fraudulent or violates these Terms.
If we cancel an order after payment, we will refund you in full.
6. Payment
We accept the payment methods displayed at checkout. Payment is processed securely by our third-party payment provider. We do not store your full payment card details.
By submitting payment information, you confirm you are authorized to use the payment method provided.
Orders are not dispatched until payment has cleared in full.
7. Shipping and delivery
Where we ship. We ship within Canada and to the United States. Local pickup and local delivery may be available in Oliver and the South Okanagan, as shown at checkout.
Shipping costs. Shipping is calculated at checkout based on destination and order weight. Costs are shown before you complete your purchase.
Processing time. Orders are typically packed and dispatched within 3 business days. Items are packaged flat with rigid protection appropriate to archival material.
Delivery estimates. Delivery timeframes provided by us or by carriers are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our reasonable control.
Risk and title. Risk of loss passes to you upon delivery to the carrier. We strongly recommend selecting a tracked and/or insured shipping option for higher-value items. Where you decline available insurance, we are not responsible for loss or damage in transit.
Lost or damaged shipments. Notify us within 7 days of the expected or actual delivery date so we can begin a carrier claim. Please retain all original packaging, as carriers may require it for inspection.
International orders (United States). You are the importer of record. Any customs duties, import taxes, brokerage fees, or other charges levied by the destination country are your responsibility and are not included in the price or shipping cost you pay us. We do not undervalue shipments or mark orders as gifts.
Local pickup. Pickup orders must be collected within 14 days of notification unless otherwise arranged. Please bring your order confirmation and photo identification.
8. Returns, refunds, and cancellations
We want you to be satisfied with your purchase. Please read this section carefully, as it applies to collectible material.
Return window. You may request a return within 14 days of delivery. Contact us at [YOUR EMAIL ADDRESS] before returning anything; returns sent without prior authorization may not be accepted.
Condition for return. Items must be returned in the same condition in which they were received, packaged with equivalent protection, and shipped by a tracked method. You are responsible for the item until it reaches us.
Return shipping. Return shipping costs are the buyer’s responsibility unless the item arrived damaged, was materially misdescribed, or the wrong item was sent — in which case we cover return shipping.
Refunds. Approved refunds are issued to the original payment method within 5 to 10 business days of our receiving and inspecting the returned item. Original shipping charges are non-refundable except where the return results from our error.
Not eligible for return. The following are not eligible unless materially misdescribed:
- items where the described condition, including normal age-related wear, is the sole reason for return;
- custom, reserved, or specially sourced items;
- items damaged after delivery.
Order cancellation. You may cancel an order at no cost before it is dispatched by emailing us as soon as possible. Once an order has shipped, the return process above applies.
9. Intellectual property and reproduction rights
This section is important, so please read it closely.
Purchase of a physical item only. When you buy a photograph, print, or other physical item from us, you acquire the physical object only. No copyright, reproduction right, publication right, licence, or other intellectual property right is transferred, expressly or by implication.
Rights in the underlying images. We make no representation or warranty as to the copyright status of the images depicted in the items we sell. Some may be in the public domain; others may remain under copyright held by photographers, estates, publishers, or other parties. It is your responsibility to determine and clear any rights required before reproducing, publishing, broadcasting, or commercially exploiting any image, and to comply with all applicable copyright and moral rights laws.
Site content. All content on the Site — including our scans, photography, watermarks, product descriptions, research notes, cataloguing, layout, logos, and branding — is owned by or licensed to us and is protected by copyright and trademark law. You may not copy, reproduce, scrape, republish, or use Site content for any commercial purpose without our prior written permission.
Prohibited uses. You may not use automated tools to harvest images or data from the Site, remove or alter watermarks, or resell our Site imagery.
10. Acceptable use
You agree not to use the Site to:
- violate any applicable law or regulation;
- transmit malicious code or attempt to interfere with the Site’s operation or security;
- gain unauthorized access to any part of the Site, our systems, or another user’s account;
- submit false, misleading, or fraudulent information;
- infringe the intellectual property or privacy rights of others.
We may suspend or terminate access to the Site for any breach of these Terms.
11. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts at our discretion.
12. Privacy
Your personal information is collected, used, and disclosed in accordance with our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with applicable Canadian privacy legislation, including PIPEDA.
13. Disputes and chargebacks
If there is a problem with your order, please contact us first at [YOUR EMAIL ADDRESS]. We aim to respond within 2 business days and will work with you in good faith to resolve the issue through replacement, return, or refund as appropriate.
Filing a payment dispute or chargeback before contacting us prevents us from helping and may delay resolution. We reserve the right to submit order records, correspondence, tracking information, and delivery confirmation in response to any dispute.
14. Disclaimers
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that descriptions, images, or other content are accurate, complete, current, or error-free.
Nothing in these Terms excludes or limits any statutory rights or warranties you may have under applicable consumer protection legislation, including the Business Practices and Consumer Protection Act (British Columbia), that cannot lawfully be excluded.
15. Limitation of liability
To the fullest extent permitted by law, and except as provided in section 14, our total aggregate liability arising out of or relating to your use of the Site or any product purchased from us shall not exceed the amount you paid for the product giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or loss of goodwill, however arising.
16. Indemnity
You agree to indemnify and hold harmless Okanagan History and its owners, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your reproduction or use of any image or item purchased from us.
17. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, wildfire, flood, severe weather, labour disruption, postal or carrier interruption, power or network failure, epidemic, or government action.
18. Third-party links
The Site may link to third-party websites or resources. We do not control and are not responsible for their content, products, or practices. Links are provided for convenience only and do not imply endorsement.
19. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time you place an order governs that order. Changes take effect when posted to the Site with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance.
20. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts of British Columbia, subject to any mandatory consumer protection rights available to you in your place of residence.
21. General
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision does not waive our right to do so later.
Entire agreement. These Terms, together with our Privacy Policy and any policies referenced at checkout, constitute the entire agreement between you and us regarding the Site and your purchases.
